Complete Purchase Terms
1. BIDDING
1.1 Participation in bidding is done with a customer number and password obtained upon application. Bids placed are binding.
1.2 The buyer is the one who has submitted the highest accepted bid at the end of the auction. If two bidders have submitted equal bids, the first bid submitted is considered the winning one.
2. COMMISSION BIDS
2.1 Participation in bidding can also be done by submitting commission bids in writing to Rekomo Auctions.
2.2 When submitting commission bids, identification must be provided. Rekomo Auctions reserves the right to disregard commission bids if the principal is deemed unable to pay for the bid submitted.
2.3 Rekomo Auctions treats commission bids confidentially and bids on behalf of the principal as favorably as possible.
2.4 The buyer is the one who has submitted the highest bid at the end of the auction. If two bidders have submitted equal bids, the first bid submitted is considered the winning one.
2.5 Rekomo Auctions is not liable for any damage that may be incurred by the principal if Rekomo Auctions fails to execute a commission bid.
2.6 The principal is responsible for purchases registered based on unclear or incorrect commission bids.
3. STARTING PRICE
The starting price of an item is based on a market-adjusted valuation of the item conducted by Rekomo Auctions. The starting price serves only as guidance, and the price at which an item is sold may significantly differ from the starting price.
4. FEES UPON PURCHASE
4.1 A bidding fee of only 125 SEK incl. VAT is added to each purchase.
4.2 In accordance with the Copyright Act (1960:729) regarding literary and artistic works, droit de suite applies with a maximum of 5% of the hammered price for the sale of artworks, ceramics, glass, silver, furniture, and textiles. Only copyright-protected works are included. The copyright protection lasts for 70 years after the year in which the author died. Sales not exceeding 5% of the basic price amount and utility art objects produced in multiple identical copies are exempt from droit de suite. Works subject to droit de suite are marked with information about the resale right during cataloging.
5. OUTCOME
5.1 It is the buyer's responsibility to verify if commission bids have resulted in a purchase.
5.2 After the auction, the buyer receives a purchase confirmation, either via email or by post, alternatively, the confirmation and invoice can be obtained under "My Pages."
6. PAYMENT
6.1 Payment can also be made by bank card or Swish on the website or to our giro account 958856-7. Specify the customer number when making the payment. We do not accept American Express or cash. Payment must be made within 7 days after the auction.
6.2 If payment is not made on time as per point 6.1, Rekomo Auctions has the right to take one or more of the following measures:
(i) Cancel the purchase.
(ii) Demand payment.
(iii) Charge a reminder fee of 50 SEK.
(iv) Charge default interest of 2% per month.
(v) Resell the item on behalf of the buyer without separate notice to the buyer. Rekomo Auctions has full and unrestricted right to determine the starting price and whether the item should be assigned a monitoring price or not. Rekomo Auctions has the right to deduct compensation for all claims that Rekomo Auctions has against the buyer from the amounts received.
7. COLLECTION
7.1 Purchased items can be collected as soon as full payment has been made and received by Rekomo Auctions. Items must be collected within 7 days after the auction.
7.2 For items not collected on time as per point 7.1, a storage fee of 50 SEK incl. VAT per auction lot and calendar day will be charged.
7.3 Rekomo Auctions' responsibility for the care of the items ceases if collection has not been made on time as per point 7.1.
7.4 For items not collected within 7 days after the auction, Rekomo Auctions has the right to take the following measures:
(i) Shipment of items to a warehouse with any chosen shipping company. All transport and storage costs are charged to the buyer.
(ii) Resale of the item on behalf of the buyer without separate notice to the buyer. Rekomo Auctions has full and unrestricted right to determine the starting price and whether the item should be assigned a monitoring price or not. Rekomo Auctions has the right to deduct compensation for all claims that Rekomo Auctions has against the buyer from the amounts received.
7.5 All transports of items to the buyer are at the buyer's expense and risk. Transport fees are charged according to the applicable price list.
8. LIABILITY FOR DEFECTS
8.1 All items are sold in their present condition. It is the buyer's responsibility to assess the condition and nature of the item through their own examination before the auction. Rekomo Auctions is not responsible under any circumstances for natural wear and tear, minor damages and defects, any stretching of canvases, the condition of frames, natural changes in living materials such as paper fading and cracks in wood.
8.2 Clocks and timepieces are sold as works of art, and Rekomo Auctions is not responsible for their technical function as timekeepers. No responsibility is taken for the function of mechanical or battery-operated items.
8.3 Information provided regarding, for example, artist, authenticity, age, technique, provenance, or condition serves only as guidance for the buyer during their examination of the item. Rekomo Auctions is not responsible for any inaccuracies in such information unless the inaccurate information was provided with gross negligence.
8.4 Depiction of items is solely for identification purposes. Rekomo Auctions is not responsible for damages or deficiencies not apparent in such depictions.
8.5 Items are sold in accordance with the provided description. Rekomo Auctions reserves the right to amend such description. Any such amendment is specified.
8.6 Rekomo Auctions has the right to remedy defects in sold items for which Rekomo Auctions is responsible. If rectification does not occur within a reasonable time from when a complaint regarding defects is made, the buyer has the right to cancel the purchase and, upon returning the item, receive the amount paid to Rekomo Auctions at the time of purchase. The buyer is not entitled to any further compensation.
8.7 Any defects must be reported immediately after the buyer discovers or should have discovered the defect, but no later than within 7 days after the auction day. However, complaints regarding information about the artist as stated in point 8.3 must be made no later than within 3 years from the purchase.
8.8 Rekomo Auctions' liability for defects is limited to what is stated in these terms.
8.9 Rekomo Auctions does not guarantee that the services on https://www.rekomoauctions.se are constantly available. Rekomo Auctions is not responsible for any inconvenience or economic effects that may affect customers due to the bidding function or other functions not being available at all times.
9. RIGHT OF WITHDRAWAL
9.1 Buyers who are consumers have the right of withdrawal in accordance with the Distance Contracts Act (2005:59) and Contracts Outside Business Premises Act. Exceptions to the right of withdrawal as stated in the aforementioned law are fully applicable to purchases.
9.2 Purchases must be withdrawn within the withdrawal period, which is a period of 14 days from the day the buyer receives the purchased item. Notice of withdrawal must be given to Rekomo Auctions in writing via email or letter within the withdrawal period. This is done most easily by sending an email to info@rekomoauctions.se.
10. DELIVERY DELAY
10.1 If a delivery delay due to circumstances for which Rekomo Auctions is responsible persists for more than 20 working days and is of significant importance to the buyer, and Rekomo Auctions should have been aware of this, the buyer may, by written notice to Rekomo Auctions, cancel the purchase and receive the amount paid to Rekomo Auctions at the time of purchase. The buyer is not entitled to any further compensation.
10.2 Rekomo Auctions' liability for delays is limited to what is stated in these terms.
11. FORCE MAJEURE
11.1 Rekomo Auctions is exempt from liability for failure to fulfill certain obligations under this agreement if the failure is due to circumstances of the kind specified below and the circumstance prevents or significantly hinders the performance in a timely manner. Circumstances constituting force majeure include, among others, acts of war, currency restrictions, shortage of transportation, fire, governmental action, changes in legislation, labor disputes, general scarcity of goods, restrictions in driving force, accidents, or other similar circumstances. If Rekomo Auctions' performance of a certain obligation is delayed by more than three months due to force majeure, the buyer may, without liability for compensation, cancel the purchase by written notice.
12. DISPUTE
12.1 Disputes regarding these terms shall be settled in accordance with Swedish law in courts in Sweden.
